These conditions regulate the purchase and use of the digital photographs offered on this website by Jeirsson Hernando Salazar Moncada.
By purchasing any photograph, the buyer fully accepts these terms.

1. Subject of the contract

These terms and conditions govern the purchase and use of digital photographs offered on this website by Jeirsson Hernando Salazar Moncada, hereinafter “the Author”, with NIF 02359594R, address in Clara Campoamor Street, 5, Castilleja de Guzmán, Seville, Spain, and contact email contacto@jeisonsalazar.com.

By purchasing any photograph, the buyer, hereinafter "the Client", fully accepts these terms.

2. Intellectual Property

All photographs are protected by the Intellectual Property Law —Royal Legislative Decree 1/1996— and are the exclusive property of the Author.

Buying an image does not transfer ownership, but grants a limited, non-exclusive, non-transferable and revocable license depending on the type of contract.

3. Types of licenses

3.1 Personal non-commercial use license

It allows Private use of the photograph: home printing, wallpaper, personal decoration, posting on blogs or social networks for non-commercial purposes.

Forbidden: any use for commercial purposes, resale, printing for profit, inclusion in monetized publications, advertising campaigns, logos or products for sale.

3.2 Standard Commercial License

It allows Use in print or digital advertising, company social media, presentations, commercial websites, books, magazines or commercial packaging, up to 500,000 copies or views.

It also allows merchandising, that is, the use of the image as a central part of physical or digital products for resale, provided that the license acquired contemplates such use.

3.3 Publishing License

It allows the use of photography in informative, educational or journalistic contexts.
Some examples include newspaper articles, informative blogs, documentaries, history books, non-commercial magazines, and traditional or digital media.

This license does not require the consent of any recognizable persons or brands in the image, as it does not involve advertising use or promote a product or service.

Forbidden: advertising or promotional use, including banners, commercial social media, or paid ads.

4. General restrictions

These restrictions apply to all licenses:

• Redistribution, resale, or gifting of the original digital file is not permitted.
• The image may not be used in illegal, violent, defamatory, pornographic, xenophobic or hateful activities.
• Its use as a logo, trademark, or part of visual identity is not authorized without an exclusive written license.
• The Client is responsible for using the image in accordance with the license acquired.

5. Duration and territorial scope

• Licenses are perpetual, They do not expire, and are valid for global use.
• The Author reserves the right to remove the image from the future catalog, without this affecting licenses already granted.

6. Guarantees and limitation of liability

• The Author guarantees that he/she holds the rights and that the images do not infringe the rights of third parties.
• Suitability for unspecified uses is not guaranteed. Misuse will be the responsibility of the Customer.
• Under no circumstances will the Author be liable for damages resulting from the improper use of the images.

7. Electronic contract and acceptance

The license is formalized at the time of purchase. By clicking “Buy” or “Accept,” the Customer agrees to these terms.
A copy of the order and license will be sent by email.

8. Applicable law and jurisdiction

These terms and conditions are governed by Spanish law. In the event of a dispute, both parties submit to the jurisdiction of the courts of Seville, unless otherwise provided by law.
